1. REFUNDS & RIGHT OF WITHDRAWAL Policy
This Refunds and Right of Withdrawal Policy forms an integral part of these Terms and Conditions and shall be governed by, construed and applied in conjunction with these Terms and Conditions and all other applicable terms, policies and notices published on the Website, as amended from time to time. In the event of any inconsistency between this Policy and any other provision of these Terms and Conditions, the relevant provision shall be interpreted so as to give effect to both wherever possible. Where this is not possible, mandatory applicable law shall prevail.
1.1 Statutory Right of Withdrawal (14 Days)
In accordance with the Consumer Rights Law of 2013 (Law 133(I)/2013), as amended, implementing Directive 2011/83/EU on Consumer Rights, where you purchase Services that have not yet commenced, you have the right to withdraw from the contract within fourteen (14) calendar days from the date of conclusion of the contract (being the date on which payment is successfully received), without giving any reason and without incurring any penalty.
1.2 Exercising the Right of Withdrawal
To validly exercise your right of withdrawal, you must notify us of your decision by means of a clear and unequivocal written statement sent exclusively to:

For the avoidance of doubt, notices submitted through any other communication channel, including telephone calls, SMS messages, instant messaging applications, social media platforms or communications with instructors or other members of staff, shall not constitute a valid notice of withdrawal.
The withdrawal notice must be received by us before the expiry of the applicable fourteen (14) day withdrawal period.
1.3 Refund Following Withdrawal Before Commencement of the Services
Where you validly exercise your statutory right of withdrawal before the Services have commenced, we shall reimburse all payments received from you.
Refunds shall:
(a) be made using the same payment method used for the original transaction unless otherwise required by applicable law;
(b) be processed within fourteen (14) days from the date on which we receive a valid withdrawal notice; and
(c) be subject to verification of the authenticity and validity of the withdrawal request.
1.4 Commencement of the Services During the Withdrawal Period
Where you expressly request that the Services commence before expiry of the statutory withdrawal period, you acknowledge and expressly consent that:
(a) the Services may begin immediately;
(b) you retain the right to withdraw during the remainder of the withdrawal period;
(c) if you subsequently exercise your right of withdrawal after the Services have commenced, you shall pay an amount proportionate to the Services supplied up to the time your withdrawal notice is received.
The proportionate amount payable may include, without limitation:
- lessons already delivered;
- access granted to digital educational materials;
- downloadable resources;
- platform access; and
- administrative, onboarding and setup costs reasonably incurred by us.
You expressly acknowledge that accessing, viewing, streaming or downloading any digital content constitutes partial performance of the Services.
Any refund payable shall equal the amount paid less the proportionate value of the Services already supplied.
Where the proportionate value of the Services supplied equals or exceeds the amount paid, no refund shall be due.
1.5 Loss of the Right of Withdrawal Following Full Performance
Your statutory right of withdrawal shall cease once the Services have been fully performed, provided that:
(a) performance commenced with your prior express request and consent; and
(b) you acknowledged before commencement that your right of withdrawal would be lost once the contract had been fully performed.
1.6 Verification of Withdrawal Requests
In order to protect the integrity of our Services and prevent abuse, we reserve the right to undertake reasonable verification measures before processing any withdrawal request or refund.
Such verification may include confirmation of:
- the authenticity of the withdrawal request;
- the identity of the purchaser;
- access logs relating to digital content;
- attendance records;
- lessons delivered; and
- materials accessed or downloaded.
Any withdrawal following access to or consumption of digital content shall be treated as a withdrawal after partial performance in accordance with Clause 1.4.
1.7 No Refunds Following Expiry of the Withdrawal Period
Following expiry of the statutory fourteen (14) day withdrawal period, no refund shall be available, whether in whole or in part, except where required by mandatory consumer protection legislation.
For the avoidance of doubt:
(a) cancellation after expiry of the withdrawal period does not entitle you to any refund;
(b) failure to attend lessons does not entitle you to any refund;
(c) failure to complete the course does not entitle you to any refund; and
(d) change of personal circumstances does not entitle you to any refund.
1.8 Presumption of Consumption of Scheduled Lessons
Where a lesson, webinar, live session or digital content is made available to you during the statutory withdrawal period, such lesson or content shall be presumed to have been accessed, viewed and consumed unless you have provided prior written notice of your intention to withdraw before the scheduled lesson or before access to the relevant digital content was made available.
Accordingly:
(a) any scheduled lesson shall be deemed delivered for the purposes of calculating the proportionate payment due under Clause 1.4;
(b) digital content made available through your account shall be deemed supplied upon being made accessible; and
(c) only written notice submitted in accordance with Clause 1.2 shall be accepted as evidence that access was not intended.
1.9 Refund Processing
All refunds approved under these Terms and Conditions, whether pursuant to the statutory right of withdrawal or otherwise required by applicable law, shall be processed through the JCC Smart payment gateway.
Refunds shall be returned solely to the payment card originally used for the transaction.
A corresponding Credit Note or other applicable tax document shall be automatically generated and issued where required by applicable law.
1.10 Refund Processing Time
Approved refunds are generally processed promptly following approval.
Depending on the payment card issuer and banking institution, the refunded amount may appear on your account within approximately five (5) to ten (10) Business Days after processing.
Processing times remain outside our control and may vary between financial institutions.
1.11 No Alternative Refund Methods
Refunds relating to card payments shall only be returned to the original payment card.
Except where otherwise required by mandatory applicable law, refunds shall not be made by cash, cheque, bank transfer or any alternative payment method.
